1. Information on how to enter and prizes form part of these Terms and Conditions. Entry into this promotion is deemed acceptance of these Terms and Conditions. By entering the promotion, entrants agree to abide by these Terms and Conditions.
  2. The Promoter is Healthengine Limited ABN 19 138 767 021 of PO Box 7754, Cloisters Square PO, WA 6850, Australia (Promoter).
  3. The promotion begins on 9 March 2023 at 9am Australian Western Standard Time (“AWST”) and ends on 26 March 2023 at 5pm AWST (“Competition Period”). The Promoter reserves the right to delay the commencement of the promotion and to also extend the closing date and time. The Competition Period will then be dates and times as varied by the Promoter.
  4. Entry is only open to Australian residents over the age of 18. Employees, their immediate families and associated agencies of the Promoter are not eligible to enter.
  5. Entry Criteria:
    a.     To be eligible to enter the promotion, an entrant must complete the entire Australian Healthcare Index survey during the Competition Period for the entry to be deemed valid. The Promoter reserves the right to either allow or disallow any entrant for any reason it sees fit in its absolute discretion.
  6. The prize winners (2 in total) will be drawn on Thursday, 6 April 2023 at 12pm (AWST). The draw will be conducted electronically at random from all eligible entries received with the first two entries drawn being the prize winners. Up to one entrant (winner) may be awarded only one prize. Each prize winner will receive one $500.00 JB Hi-Fi gift card.
  7. The competition will be drawn at Level 2, 432 Murray Street, Perth, WA.
  8. The prize winners will be notified within 48 hours of the random draw by the email address or telephone number supplied by the entrant on registration.
  9. The prize winners will be published through an announcement on the Healthengine Facebook page on Friday, 14 April 2023, by 12pm (AWST).
  10. If, by Tuesday, 25 April 2023, a prize winner does not claim the prize or does not wish to accept the prize, another random draw will take place on Friday, 5 May 2023 by 12pm (AWST) at Level 2, 432 Murray Street, Perth, WA from which a replacement winner will be selected.
  11. The Promoter will take no responsibility if a prize winner’s contact details and/or entry details are incorrect or incomplete and the prize winner cannot be contacted.
  12. The Promoter’s decision is final and no correspondence will be entered into.
  13. Prizes, or any unused portion of a prize, are non-transferable, non-negotiable and cannot be or exchanged or redeemed for cash. The Promoter accepts no responsibility for any variation to the value of the prize (or part thereof).
  14. The total prize pool value is up to AUD$1000.00.
  15. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. Identification, which includes a photograph, may be required. Prizes will only be awarded following winner validation and verification.
  16. Each prize will be sent by email or post to a winner’s nominated email address or postal address within 14 days of the prize being drawn. The Promoter will cover all postage costs. However, the Promoter  takes no responsibility for any delay in delivery, damage to prizes or lost in transit.
  17. If the prize (or part of the prize) is unavailable for whatever reason, the Promoter, in its absolute discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of like or equal value.
  18. Subject to written directions from State Regulatory bodies, the Promoter reserves the right to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.
  19. If for any reason the winner does not redeem the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
  20. All prize winners agree to the use of their name and suburb of residence for publicity and competition purposes, without compensation, unless otherwise prohibited by law.
  21. The Promoter assumes no responsibility for any error, omission, interruption, corruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer networks and systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any web site, or any combination of them, including any injury or damage to any entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Competition.
  22. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
  23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner; or (f) use of a prize.
  25. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and authorities that regulate competitions. Entry is conditional on providing this information. The collection, use and disclosure of personal information provided in connection with this promotion is further governed by Healthengine’s privacy policy which can be found on Healthengine’s website. The Promoter may, for an indefinite period, unless otherwise advised, use the information for sending electronic messages or telephoning the entrants. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. As such, the Promoter is the owner of all copyright and other intellectual property in the entries.
